Don Hurley Files Hatch Act Complaint Against Bob Levy For Prohibited Activity

Don Hurley has filed a complaint against Mayor Bob Levy of Atlantic City, NJ for violations of the Federal Hatch Act for conducting prohibited partisan political activity upon publicly owned property.

 

"Bob Levy is the poster child for what is wrong in government service today", said Hurley.

 

"Levy continues to repeat his pattern of misusing and abusing public position and property for his own personal advancement", said Hurley.

 

"For Levy to use the Office of Mayor in City Hall, the Position of Mayor and the great Seal of the city of Atlantic City as a vehicle and headquarters to conduct his partisan political activity at the expense of the tax-payers again, is a disgrace", said Hurley.

 

"Bob Levy endorsed Barbara Hudgins on city property, because she is Craig Callaway's candidate for City Council in Atlantic City", said Hurley.

 

"This proves that Bob Levy is compromised and controlled by Craig Callaway, even though Callaway sits in a Federal Prison Cell for violating the public trust and selling his office for bribes", said Hurley.

 

"It's ironic that no one in more than 15 months has ever been able to find Bob Levy  working on the job in City Hall, yet he arrived there yesterday to endorse Craig Callaway's candidate for City Council for his own advancement and that of his boss Callaway's own personal gain", said Hurley.

 

"This is just one more reason to Recall Bob Levy as Mayor of Atlantic City, a position he is unfit and unqualified to have ever held in the first place", concluded Hurley.

Re:  Complaint of Prohibited Political Activity (Hatch Act)

 

       By Mayor Bob Levy (Mayor of Atlantic City, NJ ) 

 

To Whom it may concern:

 

By way of this letter I would respectfully request to report what I believe to be a clear violation of the Hatch Act committed by the above named individual, Mayor Bob Levy, who holds the above title and position within the government of Atlantic City, NJ, which occurred on or about May 8, 2007 at Atlantic City Hall.

 

Bob Levy has presently involved himself in a Partisan Primary Election for Atlantic City Council by formally endorsing Barbara Hudgins for the position of Council Member At-Large in Atlantic City, NJ. in the Primary Election to be held in June of 2007.

 

This is a “Partisan Political” Election, wherein Mayor Bob Levy has presently endorsed an individual running for the Democrat nominee for Council Member At-Large in Atlantic City, NJ, while using the offices of Atlantic City Hall, his position as Mayor and the Great Seal of the City of Atlantic City to advance his own personal political agenda while announcing this endorsement.

 

It was just a few short years ago, that the former Mayor of Atlantic City, Lorenzo Langford received a harsh penalty from The Office of Special Council for merely signing his name to a letter, that was not produced on city property or by means of the use of any public property.

 

It should be noted that, in my belief, Bob Levy has a documented history of using the property of the tax-payers of Atlantic City for his own personal gain, as evidenced by his use of the city Fire Stations, equipment and employees in full uniform in support of his own personal campaign TV commercials for Mayor of Atlantic City in May of 2005.

 

Now, Bob Levy has utilized the Mayors Office in City Hall and his public position as Mayor of Atlantic City as a campaign vehicle and headquarters for partisan political activity.

 

It is my knowledge and belief that, in a further complaint for violations of the provisions of the Hatch Act, I am also reporting that Mayor Bob Levy utilized his public position within the government of Atlantic City, NJ while conducting what I believe to be prohibited activity by:

 

  1. Using Official Authority or influence for the purpose of interfering with or affecting the result of an election or a nomination for office by:  Utilizing a publicly owned building, (City Hall), The Office of Mayor of Atlantic City, Publicly owned equipment, for his own personal/political gain in a publicly presented endorsement upon city-owned property of another in a partisan Primary election for City Council Member At-Large of Atlantic City, on or about May 8, 2007 in the city of Atlantic City.

 

  1. Coercing, attempting to coerce, commanding, or advising a State or local Officer or employee to pay, lend, or contribute anything of value to a party, committee, organization or agency, or person for partisan political purposes.

 

 

I will continue to supplement this complaint as information is made available to me.
